Military, Defence & NCACC Regulated Products Policy
Rhino Arms (Pty) Ltd, operating under Ironcore Defense Group Pty Ltd, holds registration with the National Conventional Arms Control Committee (NCACC) in terms of the National Conventional Arms Control Act 41 of 2002 (NCACA), as amended. This policy governs the purchase, sale, transfer, and export of all conventional arms and NCACC regulated products handled by Rhino Arms.
1. Legal Framework
All transactions involving military, defence, and NCACC regulated products are governed by the following legislation and international obligations:
- National Conventional Arms Control Act 41 of 2002 (as amended in 2008)
- Firearms Control Act 60 of 2000
- South African foreign policy directives as applicable to arms transfers
- The Arms Trade Treaty (ATT)
- The UN Programme of Action on Small Arms and Light Weapons
- The Wassenaar Arrangement on Export Controls for Conventional Arms and Dual-Use Goods and Technologies
2. Scope of NCACC Regulated Products
NCACC regulated products handled by Rhino Arms include but are not limited to:
- Fully automatic and select-fire firearms
- Military specification ammunition and associated components
- Armoured vehicles and ballistic protection systems
- Explosives and demolition equipment
- Dual-use items with both civilian and military application
- Any other conventional arms or equipment classified under the NCACA
3. Eligibility to Purchase
NCACC regulated products are not available to the general public. Purchases are strictly limited to:
- Authorised government departments and agencies
- South African National Defence Force (SANDF) and South African Police Service (SAPS) procurement channels
- Licensed private security companies where applicable under law
- Foreign governments and defence forces subject to full NCACC permit approval
- Accredited dealers, distributors, and agents holding valid NCACC registration
- Rhino Arms reserves the right to verify the identity, credentials, and authorisation of any prospective buyer before processing any order for NCACC regulated products. No sale will be concluded until eligibility has been confirmed to our satisfaction.
4. Permit & Documentation Requirements
No NCACC regulated product will be sold, transferred, or dispatched without the following documentation being in place:
- Valid NCACC contracting permit where applicable
- Valid NCACC export permit for all cross-border transactions
- End-User Certificate (EUC) confirming the identity and authorisation of the final recipient
- Import authorisation from the destination country where required
- Any additional permits or clearances required under South African or destination country law
- All documentation must be submitted to Rhino Arms prior to any order being processed. Rhino Arms will not process, dispatch, or facilitate any transaction where documentation is incomplete, invalid, or in any way non-compliant.
5. Export of NCACC Regulated Products
Rhino Arms is authorised to facilitate the export of conventional arms and NCACC regulated products subject to the following conditions:
- Full compliance with the NCACA and all applicable South African export regulations
- Approval of all required NCACC export permits prior to shipment
- Confirmation that the destination country and end user are not subject to any South African, UN, or international arms embargo
- Submission and approval of a valid End-User Certificate
- Rhino Arms will not export to any country or entity that is subject to an arms embargo, has been identified as a human rights risk, or where there is reasonable grounds to believe the arms may be used in violation of international humanitarian law. This is in line with the criteria set out in Section 15 of the NCACA.
6. Pricing & Quotations
All NCACC regulated products are subject to individual quotation. No fixed pricing is displayed for military or restricted products. Pricing is provided on a per-transaction basis and is subject to:
- Product availability and current import or manufacturing costs
- Applicable permit and compliance fees
- Shipping, insurance, and logistics costs specific to the transaction
- Currency fluctuations where applicable to imported goods
7. Payment Terms
Full payment or an agreed deposit is required before any order for NCACC regulated products is processed. No goods will be released until payment has cleared and all documentation is confirmed as compliant.
8. Delivery of NCACC Regulated Products
All NCACC regulated products must be delivered via authorised and licensed channels only. Delivery terms, timelines, and logistics will be agreed upon on a per-transaction basis. Rhino Arms will not deliver any regulated product to an address or recipient that has not been verified and approved as part of the compliance process.
9. Returns & Cancellations
Due to the nature of NCACC regulated products and the extensive compliance requirements involved, all sales are final once permits have been issued and the transaction has been concluded. Returns, exchanges, and cancellations are not accepted for NCACC regulated products except where a product is found to be materially defective and subject to manufacturer warranty terms.
10. Confidentiality
In line with the NCACA and national security requirements, certain details relating to NCACC regulated transactions, including end-user information, permit details, and contract specifics, are subject to strict confidentiality obligations. Rhino Arms will not disclose any transaction details to third parties except where required by law or by the NCACC.
11. Compliance & Inspections
Rhino Arms is subject to inspection by the NCACC Inspectorate at any time in terms of the NCACA. All records, permits, and documentation relating to NCACC regulated transactions are maintained and made available to the relevant authorities upon request. Rhino Arms takes its compliance obligations seriously and will cooperate fully with any regulatory inspection or inquiry.
12. Non-Compliance & Prohibited Transactions
Rhino Arms will not facilitate any transaction that contravenes the NCACA, the Firearms Control Act, or any applicable international obligation. Any attempt to circumvent permit requirements, provide false documentation, or misrepresent the intended end use of any NCACC regulated product will result in immediate cancellation of the transaction and may be reported to the relevant authorities.
